由北京中銀（深圳）律師事務所權益合伙人譚岳奇律師與彭孝恩實習律師代理俄羅斯Agerratum公司完成跨境權利主張，為中國與金磚國家間國際商事爭議解決提供了示范樣本。
2021年11月，俄羅斯Agerratum公司與廈門某公司簽訂速凍茄子塊買賣合同。合同明確約定：因合同引起的所有爭議，應由俄羅斯聯邦工商會國際商事仲裁院解決。
2023年5月，因廈門公司未履行全部交貨義務，Agerratum公司向該仲裁院提起仲裁，索賠173，327.50美元。同年11月，仲裁院在莫斯科作出裁決：廈門公司需償付本金欠款71，250美元、罰款28，500美元及仲裁費10，876.95美元。
2024年11月，俄羅斯企業依據《承認及執行外國仲裁裁決公約》（《紐約公約》）及我國民事訴訟法相關規定，聘請中銀（深圳）律師事務所譚岳奇律師，代表其向廈門國際商事法庭申請承認該外國仲裁裁決。
中銀律師事務所團隊在譚岳奇律師帶領下，精準完成全套申請材料的公證認證與法律轉化。作為在國際仲裁領域經驗豐富的專家，譚岳奇律師在包括香港國際仲裁中心、俄羅斯仲裁中心、中國國際經濟貿易仲裁委員會在內的多家國際仲裁機構擔任仲裁員，曾作為中國大陸法律專家在香港高等法院出庭提供專業意見并作為律師在香港國際仲裁中心代理案件。
依據我國加入《紐約公約》時所作的兩項保留聲明——互惠保留與商事保留，中銀律師團隊證明本案完全符合公約適用條件：裁決在締約國俄羅斯作出，且爭議屬契約性商事法律關系范疇。

Tan Yueqi(Vincent), Equity Partner at Beijing Zhongyin (Shenzhen) Law Firm, and trainee Peng Xiaoen represented a Russian company, Agerratum, in successfully pursuing its cross-border rights claim. This case provides an exemplary model for resolving international commercial disputes between China and BRICS countries.
In November 2021, Russian company Agerratum signed a contract with a Xiamen Company for the sale of frozen eggplant cubes. The contract expressly stipulated that all disputes arising from the contract should be resolved by the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation.
In May 2023, due to the Xiamen company’s failure to fully deliver the goods, Agerratum filed arbitration with the said arbitration court, claiming USD 173,327.50. In November of the same year, the arbitration court issued an award in Moscow ordering the Xiamen company to pay:
Principal debt: USD 71,250
Penalty: USD 28,500
Arbitration fees: USD 10,876.95
In November 2024, the Russian company, represented by Tan Yueqi(Vincent) from Zhongyin (Shenzhen) Law Firm, applied to the Xiamen International Commercial Court for recognition and enforcement of this foreign arbitral award. This application was based on the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention) and relevant provisions of China’s Civil Procedure Law.
Under the leadership of Tan Yueqi(Vincent), the Zhongyin legal team accurately completed the notarization, authentication, and legal adaptation of all application materials. As an expert with extensive experiences in international arbitration, Tan Yueqi(Vincent) serves as an arbitrator at multiple international arbitration institutions including the Hong Kong International Arbitration Centre (HKIAC), Russian Arbitration Center (RAC) and China International Economic and Trade Arbitration Commission, and previously appeared as a Chinese mainland legal expert in the Hong Kong High Court and as a counsel in HKIAC .
Based on China’s two reservations upon acceding to the New York Convention—reciprocity reservation and commercial reservation—the Zhongyin legal team demonstrated that the case fully met the Convention’s application requirements: the award was made in Russia (a Contracting State), and the dispute fell within the scope of contractual commercial legal relations.
This case marks the first recognition in Xiamen court of P.R.C regarding a foreign arbitral award involving a BRICS country, demonstrating China’s judicial efficiency in fulfilling its international convention commitments. It also showcases Zhongyin lawyers’ professional competence and dedication.
