
2025年9月27日,北京中銀(深圳)律師事務(wù)所權(quán)益合伙人譚岳奇律師受邀出席長沙仲裁委員會(huì)活動(dòng)“《仲裁法》修改與國際商事仲裁中心建設(shè)研討會(huì)”,發(fā)表“中國商事仲裁國際化的幾點(diǎn)規(guī)則思考”主題演講,為促進(jìn)中國仲裁制度的完善與國際接軌提出了富有建設(shè)性的思路。
On September 27, 2025, Mr. Tan Yueqi(Vincent), Equity Partner of Beijng Zhongyin(Shenzhen) Law Firm, was invited to attend the Seminar on “the Revision of the Arbitration Law and the Construction of International Commercial Arbitration Centers” held by Changsha Arbitration Commission. He delivered an in-depth speech entitled “Reflections on the Rules for the Internationalization of Commercial Arbitration in China”, providing constructive ideas to promote the refinement and international alignment of China’s arbitration system.
本次研討會(huì)聚焦新《仲裁法》的核心修訂條款解讀、在國際商事糾紛解決中的適用難點(diǎn),國際商事仲裁中心建設(shè)面臨的共性挑戰(zhàn)與發(fā)展路徑,以及長沙建設(shè)國際商事仲裁中心的獨(dú)特優(yōu)勢、現(xiàn)實(shí)挑戰(zhàn)及實(shí)踐突破等議題展開研討。
This seminar focuses on the interpretation of the core revised provisions of the new Arbitration Law, the application challenges in international commercial dispute resolution, common challenges and development pathways in the construction of international commercial arbitration centers, as well as topics such as the unique advantages, practical challenges, and breakthroughs in practice for Changsha City in building an international commercial arbitration center.
在臨時(shí)措施、財(cái)產(chǎn)保全與緊急仲裁程序領(lǐng)域,通過將三者對(duì)比,譚律師指出臨時(shí)措施和緊急仲裁程序?qū)儆趦?nèi)生于普通法系的制度,中國仲裁界在吸收和借鑒時(shí)應(yīng)當(dāng)關(guān)注該兩種制度的獨(dú)特性。對(duì)于法律適用規(guī)則,譚律師指出,目前中國仲裁制度中所引“當(dāng)事人沒有約定實(shí)體準(zhǔn)據(jù)法時(shí),適用仲裁庭認(rèn)為合適的法律”是一個(gè)重要的發(fā)展趨勢,這里注意仲裁庭在適用實(shí)體法時(shí)與我國《涉外民事法律關(guān)系適用法》的潛在沖突,并尤其要關(guān)注強(qiáng)行法的適用。就外國法適用與專家證人制度,他提出應(yīng)引入中立專家證人。圍繞仲裁地法概念,明確仲裁地法的核心屬性是 “支配和決定仲裁程序的法律”,不同于仲裁開庭地的法律;關(guān)于其他方面,譚律師認(rèn)為應(yīng)當(dāng)注重ADR作為爭議解決方式的新的發(fā)展趨勢。在中國商事仲裁未來的發(fā)展方向上,他提出應(yīng)當(dāng)著力關(guān)注國際商事仲裁的多元化特點(diǎn)。將多元化元素注入到國際商事仲裁事務(wù)中,為國際商事仲裁的未來發(fā)展開辟更廣闊的前景。譚岳奇律師的演講立足于他的實(shí)踐和經(jīng)驗(yàn),引起了與會(huì)者的多方關(guān)注和熱烈反響。
In the field of interim measures, property preservation, and emergency arbitration procedures, by comparing the three, Mr. Tan pointed out that interim measures and emergency arbitration procedures are systems inherent to the common law system. When absorbing and drawing from these, the Chinese arbitration community should pay attention to the unique characteristics of these two systems. Regarding the rules of law application,Mr, Tan noted that the current Chinese arbitration system’s introduction of “applying the law deemed appropriate by the arbitral tribunal when the parties have not agreed on the substantive applicable law” represents an important developmental trend. Attention should be paid here to the potential conflict between the arbitral tribunal’s application of substantive law and China’s Law on the Application of Law in Foreign-related Civil Relations, with particular emphasis on the application of mandatory laws. Concerning the application of foreign law and the expert witness system, he proposed the introduction of neutral expert witnesses. Centered on the concept of the law of the seat of arbitration, he clarified that the core attribute of the law of the seat is “the law that governs and determines the arbitration procedure,” which differs from the law of the place where the arbitration hearings are held. Regarding other aspects, Mr. Tan emphasized the need to focus on the new developmental trends of ADR as a method of dispute resolution. For the future direction of commercial arbitration in China, he suggested that attention should be directed toward the diverse characteristics of international commercial arbitration. Injecting diverse elements into international commercial arbitration affairs will open up broader prospects for its future development. Tan Yueqi(Vincent)’s speech, grounded on his practice and experience, attracted widespread attention and elicited enthusiastic responses from the participants.
長沙仲裁委員會(huì)1995年由長沙市人民政府組建,現(xiàn)聘有533名國內(nèi)外仲裁員,自成立以來,辦理仲裁案件5萬余件,標(biāo)的額近1000億元。2024年受案10000余件,位居全國十大仲裁機(jī)構(gòu)之列。
The Changsha Arbitration Commission was established in 1995 by the Changsha Municipal People's Government. It currently retains 533 arbitrators from both China and abroad. Since its inception, the commission has handled over 50,000 arbitration cases, with a total disputed amount of nearly 100 billion yuan. In 2024 alone, it accepted more than 10,000 cases, ranking among the top ten arbitration institutions in China.
